Why we wrote these:
At flaire, we care about you! Our mission is to cultivate a vibrant community of travelers who embody our core values and company ethos of “explore, enjoy, and empower.” We define these as:

As a team, we’re committed to creating a space where users can explore, enjoy, and empower responsibly. To ensure a harmonious and safe environment, we have outlined the following community guidelines. These guidelines, along with our Terms & Conditions and Privacy Policy, apply to all content and communication on the platform. While the purpose of these guidelines is to define what is prohibited on Flaire, these rules are not all encompassing. We reserve the right to determine, in our sole discretion, what constitutes abuse and will not be permitted on Flaire.
How we enforce:
We are serious about our community and, therefore, serious about our guidelines. Violations may result in various enforcement actions, including warnings, content removal, account suspension, or reporting to law enforcement.
How to report:
We also invite YOU to protect this community. If you see anyone or anything that seems to violate our guidelines, values, and / or ethos, please report it to us at help@flaire.co or using this form.
Content Policy:
To protect our community of kind and curious travelers, we strictly prohibit the following:
Violence and Threats
  • Content advocating or promoting violence, making or using weapons, animal abuse, and content that incites harm
Bullying and Harassment
  • Content or activity that is abusive or negatively impacts others is not allowed, including degrading, shaming, intimidation, or harassment
Hateful Conduct
  • Discrimination, attacks, or promotion of hatred based on characteristics like race, ethnicity, gender, etc.
Harmful or Suicidal Content
  • Content promoting harm, self-harm, or suicide
Illegal Behavior
  • Content and references to engagement in illegal conduct, illicit drug use, fraudulent activities, or anything against the law
Extremism and Hate Organizations
  • Representation or support of extremism, terrorism, hate, or violence
Nudity and Sexually Explicit Content
  • Overtly sexualized content, with exceptions for non-sexualized fine art
Nudity and Sexual Exploitation of a Minor
  • Content involving child nudity or sexual exploitation
False Information
  • Misleading or false content that may cause harm
Fraud and Spam
  • Deceptive behavior, false or non-genuine solicitation, and the use of artificial intelligence for manipulation
Private Information
  • Solicitation or disclosure of personally identifiable or private information is prohibited
Non-Consensual Content
  • Depictions without consent, unauthorized content in private locations, and non-consensual intimate imagery
Copyrights and Trademarks
  • Use or posting of copyrighted or trademarked work without permission
Impersonation
  • Misrepresentation, including impersonating individuals or organizations

We love travelers of all ages! That said, to prioritize the safety and well-being of our community, Flaire requires all users to be at least 18 years of age, for the time being. We’re a small team, and this helps minimize potential risks associated with minors. Don’t worry sub-18’ers, we’re planning to grow quickly, so we can serve you soon!

Flaire is a community for expression that empowers people everywhere to create, discover, and connect by sharing lists, images, and words publicly on the web.
Generally, we do not share any non-public user information with governmental or law enforcement agencies, unless required by law. However, at times there will be situations where we may be required to share non-public information about our users with law enforcement or governmental agencies. These guidelines are intended to familiarize law enforcement and governmental agencies who are seeking to obtain user information from Flaire.
Requests for User Information
Flaire’s disclosure of user information is governed by the Stored Communications Act, 18 U.S.C. § 2701, et seq., which requires that we disclose user information to law enforcement only in response to specific types of legal process. Please refer to our Privacy Policy for more details about the types of user information that Flaire collects.
California law prohibits Flaire from responding to legal process relating to alleged violations of laws that create liability for, or arise out of, providing, facilitating, or obtaining an abortion that is lawful under California law or intending or attempting to provide, facilitate or obtain abortions that are lawful under California law. Flaire is unable to respond to legal process relating to requests for this information.
Within the United States
Flaire will respond to legally binding requests from U.S. law enforcement and governmental agencies that include one of the following documents:
  • A valid, jurisdictionally sufficient subpoena can be used to obtain basic subscriber information set out in 18 U.S.C. 2703(c)(2), namely: name, address, records of session time and duration, IP address, length of service, and means and source of payment.
  • A valid, jurisdictionally sufficient court order issued under 18 U.S.C. 2703(d) can be used to obtain other categories of non-content data regarding a user.
  • A valid, jurisdictionally sufficient federal or state search warrant can be used to obtain user content such as photos or written communications.
International Requests
Flaire may require non-U.S. governmental and law enforcement agencies to use a Mutual Legal Assistance Treaty (MLAT) request or a letter rogatory to disclose the contents of a user’s account.
Flaire may, at its discretion, provide limited subscriber non-content information to non-U.S. governmental and law enforcement agencies in response to legal process that is duly authorized in the requesting country.
Information to Include
For a U.S. or non-U.S. law enforcement request to be honored, it must be issued in accordance with governing law and include all of the following information along with the PDF of the request:
  • The following contact information:
    • Name of issuing agency
    • First and last name of the requesting law enforcement officer
    • Official email from a known law enforcement domain
    • Official direct phone number
    • Badge/ID number of the requesting law enforcement officer
    • Address of agency
  • Profile name and URL of the Flaire account in question
  • Details regarding the specific information being requested and its relationship to your investigation

Emergency Requests
Under our Privacy Policy and 18 U.S.C. § 2702(b)(8), we may share certain information with law enforcement (within our discretion) if we have a good faith belief that there is an emergency involving danger of death or serious physical injury to a person (including harm to a minor).
When submitting an Emergency Disclosure Request you must include the following information:
  • Identity of the individual in danger of death or serious physical injury;
  • The nature of the emergency and why it poses a threat of imminent death or serious bodily injury that would justify immediately disclosing the requested information rather than relying on standard legal process;
  • * Information in Flaire’s possession you are seeking to obtain on an emergency basis; and
  • * How the specific information requested will assist in averting the threatened death or serious physical injury.

Account Preservation
In accordance with 18 U.S.C. 2703(f), Flaire will accept requests to preserve user records for 90 days that may be relevant in a criminal legal proceeding.

Child Safety
Flaire will remove any content that comes to our attention that depicts (or may depict) sexually explicit images of minors or appears to sexualize or exploit children, including content drawn to our attention by government requests. We will promptly report this content to the National Center for Exploited and Missing Children, which may relay this and related information to U.S.- or foreign-based law enforcement agencies.
If a request involves a child exploitation or safety matter, please specify that in the request so that we may quickly address the request.
Data Retention
In accordance with our Terms of Use, Privacy Policy, and applicable law, Flaire retains different types of user information for various periods of time. Due to the nature of the information on Flaire, we may store some user information for only a short period of time. Unless we receive a valid preservation request, we generally do not retain information for law enforcement purposes.
Notification
We will not notify users if we are prohibited by law from doing so (for example, by an order under 18 U.S.C. § 2705(b)), or if we believe that an exceptional circumstance exists, such as child exploitation, the threat of imminent death or bodily injury, or where notification would be counterproductive (e.g., due to an account takeover). Absent these exceptional circumstances, we will make efforts to provide delayed notice to affected users when prior notice is prohibited, following expiration of the non-disclosure order and where permitted by law.
Testimony
Records produced in response to law enforcement requests are self-authenticating and do not require the testimony of records custodians. We are unable to provide expert testimony.

Cost Reimbursement
Under 18 U.S.C. §2706, Flaire may seek to be reimbursed for any costs we incur in responding to information requests. Unusual or extensive requests may incur additional costs, but we may waive fees at our discretion.

    • user is responsible for all information in their comments, photos, blogs, postings, etc — user generated content — flaire isn’t responsible for the public posting of private information
    • all user submissions are non-confidential and non-proprietary and may be shared with others on other sites and platforms
    • user promises submissions, and our use of such content as permitted by these Terms, will not violate any rights of, or cause injury to, any person or entity. Although we have no obligation to screen, edit or monitor Submissions, we may delete or remove Submissions at any time and for any reason with or without notice.
    • cannot contain images of any children (other than your own) under the age of 18 absent such children’s parental consent.
    • flaire has non-exclusive, worldwide, royalty-free, fully sublicensable license to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce, make available, transmit, broadcast, sell, translate, and create derivative works of that UGC, and your name, voice, likeness and other identifying information
    • no “prohibited content” — inappropriate, defamatory, false, obscene, violent, vulgar, unlawful, or otherwise objectionable — may result in account suspension or termination.
    • we can monitor all content, but are not obligated to do so, and can remove or refuse content without notice to the user

  • Flaire can suspend operation of, or access to, the app without notice at anytime. any aspect of the app can be changed or removed at any time.
  • in use of services, user agrees not to:
    • break any laws
    • violate or infringe on any IP
    • interfere or damage our services (i.e. viruses)
    • scrape any of our webpages
    • display our services or proprietary info anywhere
    • test vulnerability or breach security
    • circumvent any technological measure implemented by Flaire
    • reverse engineer any of the software used

  • we do not permit copyright infringing activities or infringement of intellectual property rights and will remove if properly notified that content infringes on another’s intellectual property rights.
  • we are not responsible for content on linked sites
  • limitation of liability — services, tools, and content are provided “as is, as available.” we do not guarantee it is error-free, 100% accurate, free of viruses. user assumes entire risk of quality and performance of services. applies to any damages, liability or injuries, whether for breach of contract, tort, negligence or any other cause of action. Flaire parties are not responsible for any damages. If we are found to be liable for anything, the max is $50, unless these exclusions don’t apply in user’s jurisdiction.
  • indemnity — will indemnify, defend, and hold harmless flaire parties in connection with the services. You agree to promptly notify the Flaire Parties of any third-party Claims, cooperate with the applicable Flaire Parties in defending such Claims and pay all fees, costs, and expenses associated with defending such Claims. Flaire Parties retain the right to assume the exclusive defense and control of any Claims and have the exclusive right to settle such Claims. You will not settle any Claims without, in each instance, the prior written consent of the relevant Flaire Party.
  • alpha services — as is, not complete, not free of error, use at your own risk
  • if terms are violated, access can be blocked or terminated, and violation will cause irreparable harm to Flaire for which monetary damages would be inadequate, and Flaire can obtain any relief it deems necessary or appropriate. These remedies are in addition to any other remedies Flaire may have at law or in equity.

  • not all services are guaranteed outside of the US; users outside the US are responsible for applicable local laws
